By accessing and using the Yodha Elevators website (yodhaelevators.com) and our services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services Provided

Yodha Elevators provides the following services:

  • Elevator installation and manufacturing
  • Elevator maintenance and AMC (Annual Maintenance Contract)
  • Elevator modernization and upgradation
  • Elevator repair and emergency services
  • Consultation and technical support

All services are subject to availability and may be modified, suspended, or discontinued at any time without prior notice.

3. Quotations and Pricing

3.1 Quotations

All quotations provided by Yodha Elevators are valid for a period of 30 days from the date of issue, unless otherwise stated. Prices are subject to change without notice.

3.2 Pricing

All prices are quoted in Indian Rupees (INR) and are exclusive of applicable taxes, duties, and government levies unless otherwise specified. Final pricing will be confirmed upon acceptance of the quotation and signing of the service agreement.

4. Payment Terms

4.1 Payment Schedule

Payment terms will be specified in the service agreement. Generally, payments are structured as follows:

  • Advance payment: As specified in the agreement (typically 30-50% of total project cost)
  • Progress payments: Based on project milestones
  • Final payment: Upon completion and handover of the project

4.2 Late Payments

In case of delayed payments, Yodha Elevators reserves the right to:

  • Suspend work until payment is received
  • Charge interest on overdue amounts at a rate of 18% per annum
  • Terminate the agreement with appropriate notice

5. Installation and Project Terms

5.1 Site Preparation

The client is responsible for:

  • Providing proper site access and working conditions
  • Obtaining necessary permits and approvals from local authorities
  • Ensuring structural readiness as per our specifications
  • Providing adequate power supply and utilities

5.2 Installation Timeline

Installation timelines are estimates and may vary based on:

  • Site conditions and accessibility
  • Weather conditions
  • Availability of materials and components
  • Client's timely approvals and payments
  • Unforeseen circumstances beyond our control

5.3 Delays

Yodha Elevators shall not be liable for delays caused by factors beyond our reasonable control, including but not limited to natural disasters, government actions, labor strikes, or client-caused delays.

6. Warranty and Guarantee

6.1 Product Warranty

Yodha Elevators provides warranty on elevators and components as per manufacturer specifications, typically:

  • Elevator equipment: 12-24 months from date of installation
  • Workmanship: 12 months from date of completion
  • Specific warranty terms will be detailed in the service agreement

6.2 Warranty Coverage

Warranty covers defects in materials and workmanship under normal use. Warranty does not cover:

  • Damage due to misuse, negligence, or accidents
  • Damage due to unauthorized modifications or repairs
  • Normal wear and tear
  • Damage due to natural disasters or acts of God
  • Consumables and routine maintenance items

6.3 Warranty Claims

To claim warranty service, clients must:

  • Notify us in writing within 7 days of discovering the defect
  • Provide access to the site for inspection
  • Maintain proper maintenance records

7. Maintenance and AMC Terms

7.1 Annual Maintenance Contract (AMC)

AMC services include:

  • Regular scheduled maintenance visits
  • Inspection and testing of safety systems
  • Replacement of consumables (as per contract)
  • Emergency response during contract hours

7.2 Maintenance Obligations

Clients are required to:

  • Provide safe and accessible working conditions
  • Report issues promptly
  • Make timely payments as per contract
  • Allow scheduled maintenance visits

8. Liability and Indemnification

8.1 Limitation of Liability

Yodha Elevators' total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service in question. We shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Damage to property not directly caused by our negligence

8.2 Indemnification

The client agrees to indemnify and hold Yodha Elevators harmless from any claims, damages, or expenses arising from:

  • Client's breach of these terms
  • Client's negligence or misconduct
  • Unauthorized modifications to the elevator system

9. Safety and Compliance

Yodha Elevators is committed to safety and compliance with all applicable laws and regulations, including:

  • Indian Elevator Act and regulations
  • Building codes and safety standards
  • Electrical safety regulations
  • Local municipal requirements

Clients must ensure compliance with all local regulations and obtain necessary permits before installation.

10. Intellectual Property

All designs, drawings, technical specifications, and documentation provided by Yodha Elevators remain our intellectual property. Clients may not reproduce, distribute, or use these materials for purposes other than the intended project without written permission.

11. Cancellation and Refund Policy

11.1 Cancellation by Client

If the client cancels a project:

  • Before work commencement: Refund of advance payment minus 10% administrative charges
  • After work commencement: Payment for work completed and materials ordered, plus applicable cancellation charges

11.2 Cancellation by Yodha Elevators

We reserve the right to cancel or suspend services in case of:

  • Non-payment or breach of payment terms
  • Breach of contract by the client
  • Unsafe working conditions
  • Force majeure circumstances

12. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, strikes, government actions, pandemics, or other force majeure events.

13. Dispute Resolution

13.1 Amicable Resolution

Parties agree to attempt amicable resolution of disputes through good faith negotiations before pursuing legal action.

13.2 Jurisdiction

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India. These terms shall be governed by Indian law.

14. Modifications to Terms

Yodha Elevators reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These terms, together with any signed service agreement, constitute the entire agreement between the parties and supersede all prior agreements, understandings, or communications.
